Introduction
The Liberty Protection Safeguards were introduced by the Mental Capacity (Amendment) Act 2019. They will replace the Deprivation of Liberty Safeguards in the Mental Capacity Act 2005, by establishing a new scheme for authorising the deprivation of liberty of people lacking the relevant capacity, for example as a result of dementia or learning disabilities.
They apply in any setting including care homes, supported living, hospitals and domestic and family settings.
The start date for the Liberty Protection Safeguards will be announced later this year. They will have a major impact on mental capacity law and all those affected by it, including service users, patients, family carers, health and care professionals, regulators, advocates and mental capacity lawyers.
Presented by Tim Spencer-Lane, this live broadcast session will help you to get up to speed with the Liberty Protection Safeguards before they come into force. It will cover in detail how the new scheme will operate, how assessments must be conducted, and the revised role of the Court of Protection. The session will also cover the draft Code of Practice and regulations which have been published for consultation.
It will also provide an opportunity to ask questions and discuss how the new law will impact on your practice.
