Introduction

The issue of deprivation of liberty applies to people of all ages, including children.

Article 5 of the European Convention on Human Rights (‘ECHR’) guarantees the right to personal liberty and provides that no one should be deprived of their liberty in an arbitrary fashion. However, in some cases a child or young person with a mental disorder will need to be deprived of their liberty in their best interests.

This live broadcast session will cover valid consent, the zone of parental responsibility and best interests decision-making.

It will also look at the legal processes for authorising the deprivation of liberty of a child and how they interact.

What You Will Learn

This live and interactive broadcast will cover the following:

  • How to apply Cheshire West in the context of children and young people
  • The zone of parental responsibility: can parents consent to a deprivation of liberty for their child?
  • Can a child with capacity/competence consent to a deprivation of liberty?
  • Can deprivation of liberty occur in the family home and other ‘private’ settings?
