This 5 hour conference will cover the following:

10:00am-11:00am: Motor Vehicles (Compulsory Insurance) Act 2022 - The New Landscape in RTA

The Act makes clear the distinction between UK law and European Motor Insurance Directives. Redefining the Road Traffic Act 1988, and the meaning of ‘motor vehicles’ and ‘used on roads or other public places’ and the requirement for compulsory third-party insurance.

Accidents that occur on private land and those involving ‘off-road’ vehicles will no longer require compulsory insurance and its absence will mean the MIB is no longer an option.

This session will get you up to speed on all the implications for your RTA caseload.

• ‘Motor vehicle’ - definitions and new implications
• Part VI RTA 1988- and the requirement for compulsory Insurance
• Section 156A -retained EU case law, such as Vnuk, will cease to have effect in the UK
• No insurance requirement and no MIB claims for ‘off -road’ accidents

11:10am-12:10pm: Case Law Update

This session will cover:

• A summary of the major liability, quantum and procedural cases from the last year

12:10pm-1:10pm: Costs Update - Key Tips for Profit & Cashflow

Personal injury litigation, more than any other area of law, has been faced with enormous challenges during the last 10 years in particular.

This session will target some key tips for ensuring profit and cashflow are maximised to their fullest, including:

• Getting the most out of your hourly rate charges and recovery
• Time recording best practice to avoid time leakage
• Getting the costs in early - how to drive payments on account and costs settlement
• Latest case law on all the hot topics, including budgeting, Part 36, and proportionality

2:00pm-3:00pm: Whiplash Reforms

Part I of the Civil Liability Act 2018 is now fully in force.

A completely different (and much less attractive) regime now applies to claims for damages arising from certain types of injury caused by road traffic accidents occurring on or after that date.

This session will include:

• Setting out types of claims which are exempt from the regulations
• How to make the most of the situation

3:15pm-4:15pm: MIB Uninsured Exclusions

This session will update you on the latest issues, case law and tactics relevant when dealing with the MIB. With particular focus on the exclusions in clause 8 of the uninsured agreement and the arguments that will lead you to successful outcomes for your clients.
