In the last few years case law has played a huge part in determining what should be included in the Holiday Pay calculation. The most recent case, Harpur Trust v Brazel, confirmed holiday leave rights for casual workers / zero-hour contracts.
The government has responded to the consultations issued in 2023, and draft legislation confirms the 12.07% can be used for casual workers / zero-hour contracts, for both calculating entitlement and rolled up holiday. However, what about full time and part time workers? How do we calculate their ‘normal’ pay?
